The U.S. Citizenship and Immigration Service (USCIS) has issued an updated I-9 form, with minor changes, for use with all new hires. The updated Form I-9, with an edition date 1/20/25 and an expiration date 5/31/27, is available for download. Although we advise that our clients start using the updated Form I-9 immediately, employers may continue to use prior editions of the I-9 form until their respective expiration dates. Those versions include:
- The 08/01/23 edition, valid until May 31, 2027.
- The 08/01/23 edition, valid until July 31, 2026. Employers using this edition in an electronic system must, by July 31, 2026, update their system with an edition of Form I-9 bearing a 05/31/2027 expiration date.
The new Form I-9 includes several updates:
- The fourth checkbox in Section 1 has been renamed to “An alien authorized to work.”
- Descriptions for two List B documents in the Lists of Acceptable Documents have been revised.
- The instructions now feature clearer statutory language and an updated Department of Homeland Security (DHS) privacy notice.
- The updated Supplement B, Reverification and Rehire (formerly Section 3) on page 4 replaces Section 3 on the previous version of Form I-9. Only use this page if your employee requires reverification, is rehired within three years of the date the original Form I-9 was completed or provides proof of legal name change.

We recommend ensuring the new Form I-9 replaces any older version by the deadline specified above and is used for all new hires. However, it is not necessary that current employees fill out the form again.
As a reminder, an employee must complete Section 1 of Form I-9 by their first day of work, and the employer must complete Section 2 within three business days of the employee’s date of hire.
